TERMS OF USE FOR MENTORS

Attention: Please read these terms carefully before using the website ‘https://careeocity.com/’ (hereinafter referred to as ‘Careeocity’). By using this website, you agree to abide by these Terms and Conditions, including but not limited to Policies, Reviews, Rules, and Guidelines, as applicable. These shall be deemed to be part and parcel of these Terms and Conditions (hereinafter referred to as “TERMS”) and may be amended by the Company from time to time without prior notice. The Company reserves the right at its sole discretion to change, modify, add, or remove portions of these Terms at any time. It is your responsibility to review these Terms periodically for updates/changes. Your continued use of Careeocity shall signify your acceptance of these Terms. As long as you comply with the Terms, we grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use Careeocity.

Careeocity provides a platform where professionals and students (hereinafter referred to as ‘Mentees’) seek guidance from industry experts (hereinafter referred to as ‘Mentors’).

By registering as a Mentor on Careeocity, you represent yourself as an expert in your chosen domain(s) and warrant the Company in this respect.

TERMS & CONDITIONS

1. Eligibility

Accessing or using Careeocity indicates your agreement to these Terms. Only individuals who can form legally binding contracts under Indian Contract Law are permitted to use Careeocity. The Company reserves the right to terminate your account if it is found that you are not eligible to use this platform. The eligibility here is defined by Careeocity with no liability to disclose it to any party.  Careeocity is free to modify the eligibility from time to time at its sole discretion without any liability to give prior notice to the Mentors.

2. Mentor Services

The Mentor agrees to provide guidance and mentoring to the Mentees in good faith and to the best of their ability via audio, video, or other modes of communication available on Careeocity only. Any direct communication by Mentor to the mentee excluding Careeocity’s involvement gives Careeocity the right to instantly terminate the contract with the Mentor or take any corrective action as it deems fit. 

3. Prohibited Activities
4. i) The Mentor shall not use Careeocity for any illegal or unauthorized purpose or engage in activities that violate any applicable laws (including but not limited to copyright laws). Screenshots, recordings, or unauthorized sharing of content (including Email Id/’s, External Links, or any form of mutual connection details whatsoever) from Careeocity are strictly prohibited.
5. ii) The mentors shall not discuss or advise on anything outside the gambit of career counselling or career related guidance. The discussions should be strictly related to mentees’ professional or career related queries and associated mentoring.
6. Account and Registration Obligations

Mentors are solely responsible for maintaining the confidentiality of their account credentials. Any unauthorized use of the account should be immediately reported. The Company shall not be liable for any loss due to unauthorized use of the account.

5. Content Moderation

The Company may monitor, edit, or remove content that is deemed unlawful, offensive, defamatory, obscene, or in violation of these Terms.

6. Compensation

Mentors shall receive fees for their services based on dynamic, fixed or agreed pricing. Payments shall be auto-credited to the registered bank account of the mentor within 72-96 hours of the session completed (except in case of any complaint/dispute raised by the mentee and then the payment will be paused until the appropriate resolution by Careeocity) , subject to TDS deductions. The compensation here should be kept confidential by the mentor and in case of breach of confidentiality, Careeocity reserves the right to modify the compensation structure or terminate the contract in case of extreme scenarios.

7. Independent Contractor Relationship

The relationship between the Mentor and the Company is that of independent contractors. No employer-employee relationship exists.

8. Liability Disclaimer

The Company shall not be liable for any misrepresentation or omission of information by the Mentor or Mentee.

The Company and the Mentor shall not be responsible for any damages or losses incurred by the Mentee based on the mentorship provided.

However, in case of any inappropriate language or behaviour used by the mentor during the session or other interactions on the platform only, the mentor will be solely liable for such conduct and in no way represents CareeoCity’s interests in such cases. However, CareeCity, in good faith, will intervene and make efforts to resolve such cases to the best of its capacity, though in no way being liable for such cases. 

9. Refunds & Deductions

Disputes and complaints must first be referred via email (info@careeocity.com) to Careeocity with supporting proof and session recordings. The Company reserves the right to adjust any refundable amount from the Mentor’s future payments as applicable. Refunds may be issued in cases of unresolved disputes, non-fulfillment of sessions, or violation of service agreements by the Mentor.

10. Privacy & Data Security

The Company is committed to protecting user data. However, given the evolving digital landscape, it shall not be held liable for any data breaches beyond its control.

11. Service Quality Expectations

Mentors are expected to maintain high service quality, including ensuring a stable internet connection and meeting platform requirements.

12. Fee Adjustments & Taxes

Service fees are subject to periodic revisions and applicable tax deductions.

13. Bank Details & Payments

The Mentor is responsible for ensuring accurate bank details are provided for payments. Any loss due to incorrect bank details shall be the sole responsibility of the Mentor.

14. Non-Solicitation Clause

Mentors shall not solicit or poach Mentees for private consultations outside the platform. Solicitation includes, but is not limited to, directly reaching out to Mentees for paid or unpaid mentoring services, offering alternative mentorship programs, or redirecting Mentees to external platforms or personal services without prior written consent from the Company. In case of any such incident, the company reserves the right to cease payment of any unpaid fees if it is concerned with the discussed case or may have the right to instantly terminate the contract. 

15. Confidentiality

Mentors shall not disclose confidential information obtained from Careeocity to third parties. Careeocity retains full rights over all mentorship materials, including content, recordings, and any proprietary information shared within the platform.

16. Non-Compete Agreement

Mentors agree not to start a competing mentorship platform for a period of three years after signing up with Careeocity, either globally or within the geographic regions where Careeocity operates.

17. Suspension & Termination

The Company reserves the right to suspend or terminate Mentor accounts based on user feedback or subpar service quality. Factors that may contribute to termination include consistent low ratings, frequent cancellations, inappropriate conduct, or failure to comply with platform policies.

18. Assignment of Rights

The Company may assign its rights or obligations to any third party without prior notice.

19. Recording of Sessions

All sessions are to be compulsorily recorded by the mentor and shared with Careeocity on mail (info@careeocity.com) within 6 hours of completion of the session. In case of a claim or dispute by a Mentee/Mentor, the session recording will be the primary evidence referred to by Careeocity. 

If the mentor fails to share the recording or causes a delay in sharing the recording, the mentor will be fully liable for any dispute/complaint raised by the mentee for that session. Careeocity reserves full rights to recover the compensation to mentee from the mentor in monetary terms or as an adjustment against the fee payment(s) due to the mentor for that session and/or upcoming sessions.

These recordings will be used for dispute resolution and will be stored by CareeoCity for 30 days post the day of the session. The videos will be deleted from the company database on the 31st day. 

There may be cases where the platform might prefer to keep the session recordings for a longer period of time for social media usage, training amor quality purposes. In such cases, due consent will be taken from the mentor in advance. 

20. Copyright Ownership

All recorded sessions, discussions, and content created on Careeocity remain the intellectual property of the Company.

21. Indemnification

Mentors agree to indemnify and hold harmless the Company from any claims arising due to breach of these Terms.

22. Privacy Policy & Personal Information

Mentors’ personal data shall be collected, stored, and processed in accordance with the Company’s Privacy Policy.

23. Use of Cookies & Data Collection

The Company may use cookies and other tracking technologies to enhance user experience and improve services.

24. Mentor Approval

Mentors will be approved by Careeocity based on platform requirements, industry needs, profile suitability, and available vacancies. Careeocity retains full rights to accept or reject any mentor registration request without disclosing reasons.

26. Cancellation Policy

Mentors are requested to not cancel a session unless it is extremely unavoidable. Mentors need to send an email to info@Careeocity.in with the request along with alternate time-slots to reschedule the session. Given the session would already been paid-for by the mentees, Careeocity will handle the scenario on a case to case basis and suggest a resolution accordingly which may not be limited to but might include monetary penalty on the mentor that can be adjusted directly or through future fee payment adjustments.

27. Rescheduling the session

Mentors don’t have an option to reschedule a session. However, in case of an unforeseen scenario, the mentor may send the request to Careeocity at info@Careeocity.in. Careeocity will have the full rights to take an action here basis mentees’ availability and consensus. In case the mentee does not agree to rescheduling, the session will have to be conducted or cancelled on the basis of the policy. 

28. No-show

If the mentor does not attend a scheduled session, strict action will be taken against the mentor which may not be limited to but might include monetary penalty on the mentor that can be adjusted directly or through future fee payment adjustments. In extreme cases, Careeocity reserves the full right to terminate the contract with the mentor.

In case of mentor joining a session late, the mentor will either have to conduct the full duration if agreed by the mentee, else the payment will be on a pro-rata basis for the duration of the session. In addition to this, strict action will be taken against the mentor which may not be limited to but might include monetary penalty on the mentor that can be adjusted directly or through future fee payment adjustments.

Severability Clause If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

By using Careeocity, you agree to these Terms and any amendments made from time to time. It is your responsibility to review these Terms periodically for updates.
